Policies

We take your privacy and security very seriously. We value our customers and appreciate your trust in us. As it regards to all our policies, any usage of "we", "our" or "us" refers to the online disc production service provider, and "you", "your" or "the customer" refers to the end customer who produces and/or purchases products through the service.

Our secure server protects your credit card data using 128-bit encryption. It provides a completely safe way to submit confidential information via the Net. All order information you provide to us and all information contained in your "Account" is transmitted using SSL (Secure Socket Layer) encryption. SSL is a widely used coding system that lets your browser automatically encrypt or scramble data before you send it to us. Transactions will not be permitted if your browser does not accept SSL encryption. Only authorized personnel from our company or its partners can decode this information and such personnel will only do so in accordance with our Privacy Policy. In addition, to attempt to deter the theft of credit card numbers and other personal information residing in our system, we have installed secure "firewalls" and/or have implemented other security measures to help protect our systems against "hacker" break-ins. Additionally, all credit card numbers are encrypted in our system and cannot be read by our employees.

You can tell that your connection is secure when you have an unbroken key or closed lock at the bottom left corner of your browser. Also, the URL address window at the top of your browser will begin with "https" rather than "http" to indicate that you are using a secure server.

In order to set up an account, each customer is required to provide us with their name, phone number, email address and a password. Upon placing an order, customers are further required to provide additional personal information including an address, payment information (e.g. credit card number) and shipping information. This information is all used in the normal course of business to contact a customer to verify details about an order and send out the completed order. Additionally, upon placing orders, we will store contact, shipping and credit card information for future use. We do this to improve the customer experience.

We will not provide your name or account information to any third party, except those who need it to help us conduct normal daily business (such as providing a mailing address to a shipping carrier) or as stated below. Any content or graphics that you send us for production will only be used for that purpose and will never be made available to a third party or used in any other way except as stated below. Only you will have access to your content and graphics, which will be safely stored in your password-protected account until destroyed. We reserve the rights to all graphics, content and masters that have not been used for duplication orders for more than three months.

We reserve the right to disclose account and personal information we reasonably feel is necessary to protect our systems or business or when we believe such disclosure is necessary to comply with the law, to cooperate with an investigation of activities claimed to be unlawful or to protect the rights or property of the company or others.

We may use "cookies" to enhance the customer experience on the website. A cookie is a small piece of data that is stored on the customer's computer. We may use cookies to identify non-personally identifiable information about the customer.

If the company goes through a business transaction, such as a merger or acquisition or a sale of a portion of its assets, customers' personal information will, in most instances, be part of the assets transferred. We will notify you of any changes to the privacy policy as a result of such transaction.

As our customer, you must represent and warrant that you own or have permission to use any copyrighted material that you mail to us or upload to your account, and that you will dispose of copies in accordance with the rights you hold and that your are complying with our policy on intellectual property.

We reserve the right to cancel the service or close accounts that have been inactive for an extended period. We may do so after sending out an email warning to the address associated with the account. We reserve the right to refuse service to anyone for any reason including those who do not comply with our standard terms of operation. We enforce this policy to ensure a professional environment for the users of our system.

We will send email communication to customers regarding orders and important announcements including, but not limited to, policy changes and content retention notices. Additionally, we will send out periodic emails about marketing promotions, new products and offers from our partners. Customers are able to unsubscribe from email communications from their My Profile page or via physical mail.

Uploaded Content:
Once content is uploaded, it will be stored for 3 months. If an order has not been submitted using the content by the end of that time period it will be deleted. Once an order is submitted, uploaded content is stored for 13 months after the order date. You will receive an email notifying you that content is about to expire and extendible by an additional 6 months by clicking the 'Renew' button next to the expiring content that is listed in the My Content section of your account. Only one renewal is offered, after which, an order using the content will need to be submitted to prevent it from being deleted. Once deleted, content cannot be recovered.

Mail in Master Content:
We store content on mail in masters for 24 months after your last order using this content. After that time, your master will be destroyed.

You are entirely responsible for the content you deliver to us for reproduction. Content includes, but is not limited to, data, audio, video, images, text, graphics or other material incorporated in your project. You are specifically responsible for obtaining any permissions for any project submitted to us which may be required from third parties and warrant that your products do not infringe upon the rights of any third party, including copyright, trademark or privacy.

Under the United States Copyright Law you cannot reproduce other people's copyrighted works (including songs, recordings, movies, photographs and drawings) without first obtaining express or implied permission from the copyright owner or without qualifying for specific exemptions under the law, such as the use of works in face-to-face teaching activities and other specific types of "fair use." Trademark laws prohibit you from using another's trademark or tradename in a way that is likely to cause confusion or mistake about where the product comes from. And, many State laws protect people from having their names or likenesses used without permission.

Your delivery of content to us includes a representation from you that one, or any combination, of the following is true: (1) you are the owner of the copyright in the content by transfer and/or purchase from the copyright owner; (2) you created the content yourself and own the copyright in the content; (3) you have a direct or implied license from the copyright owner, or an authorized agent, to copy the content; (4) the contents are in the public domain or have been abandoned to public use or are not copyrightable; (5) your use of the contents falls within established exemptions in the copyright law for teachers or uses by government agencies; (6) you have a good faith belief that your use of the content is "fair use" as defined by the copyright laws of the United States.

We have no obligation to monitor any materials that you submit for duplication. However, you acknowledge and agree that we have the right, but not the obligation, to monitor any submitted materials, and to disclose any information to any third party in order to operate business properly; to protect ourself and our customers; and to comply with legal obligations or governmental requests. We respect all intellectual property rights and expect everyone who uses our services to also respect them. We are relying on your representations and warranty about the content you provide to us as a condition to your using our service. We reserve the right to (a) cancel an order or cancel the account of anyone found to violate the intellectual property rights of third parties and (b) to share the submitter's account information with government organizations, law enforcement authorities or other third parties as necessary.

By becoming our customer, you agree to indemnify and hold us harmless and accept responsibility for reimbursing us for any costs, expenses or liability we incur if you use our service in any way that is incompatible with our policies or violates any US or international laws.

Due to the custom nature of each order, all orders are final and no returns are permitted. We will replace any defective or non-conforming goods in the event of our error. However, no reprints or refunds will be given more than 30 days after receipt of an order. Defective goods are those goods that do not perform or appear as intended due to a manufacturing error; defective goods do not include products which are accurate reproductions of customer-supplied artwork or content. Orders cannot be returned due to color variations that are normal within or between runs. Colors seen on a computer monitor depend on the calibration of that monitor and can only approximate the appearance on a final physical product. There are colors which can be displayed on a screen which cannot be reproduced in print and vice versa, though typically, they are very comparable.

If your order is lost or damaged in transit, please contact us and we will replace or refund your order as necessary.

We store artwork for 2 year after it was last ordered. After which time, your artwork will be deleted, no notification will be sent prior to deletion. You can download your artwork at any time from the My Artwork area of your account.
